RERA Registration
The acronym RERA stands for Real Estate Regulatory Authority (“RERA”) which is established under the Real Estate (Regulation & Development) Act (“Act”). This Act was introduced in the year 2016 to regularise the problems existing in the real estate sector. The Act will be implemented at the State level, and the governing authorities are responsible for the following:
Objectives of RERA Registration:
- Transparency and accountability towards consumers.
- Resolution of grievances through a dispute resolution mechanism.
- Reduction of fraud through increased compliances.
- Reduction of delays through fair play.
- Establishment of professionalism and standards.
- Creation of awareness and promotion of good governance practices.
- Imposition of responsibilities on promoters and buyers for smooth transactions.
- Setting up an Appellate Tribunal for appeals.
Applicability of RERA Registration:
- Applies to promoters, real estate agents, builders, developers, contractors, etc.
- Applies to commercial buildings, residential apartments, and plots developed for sale.
- Applies to real estate projects exceeding 500 sq. meters or having more than eight apartments.
Documents Required for Promoter Registration:
- PAN card of the promoter.
- Parking slots availability.
- Legal title deeds, Encumbrance Certificate, Commencement Certificate.
- Sanction Plan, Layout Plan, location details of the project.
- Plan of development works.
- Details of previous project experience.
- Consent of the owner, Development Agreement, Joint Development Agreement (if not the landowner).
Documents Required for Real Estate Agent Registration:
- PAN, permanent address proof, photograph.
- Details of the real estate agent enterprise.
- Particulars of enterprise registration, if applicable.
Registration Process:
- Promoter issued Registration Number, Login Id, and password.
- Fees vary by state, based on the area for promoters and entity type for agents.
- Valid for the period declared by the promoter, extendable in case of natural calamities.
